Terms of Service
Diamond Hands Game – Terms and Conditions (Last Updated: May 24, 2025)
Welcome to the Diamond Hands Game (“the Game”), a blockchain-based gamified experience on the Solana network inspired by cryptocurrency meme culture. These Terms and Conditions (“Terms”) govern your access to and participation in the Game, which is offered by the Game’s operator (hereinafter “the Company,” “we,” or “us”). By participating in the Diamond Hands Game or using any related website or service, you acknowledge that you are 18 years of age or older and that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not participate in the Game. Participation in the Game is void where prohibited by law.
Please carefully review the following key points before proceeding:
Age Restriction: The Game is intended for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to participate. By entering the Game, you represent and warrant that you meet this age requirement.
Entertainment Purpose – Not Financial Advice: The Diamond Hands Game is for entertainment purposes only. Nothing in the Game constitutes financial or investment advice, and the Game should not be viewed as an investment opportunity or a source of guaranteed income. We make no promises of earnings or profits from participation. You alone are responsible for any decisions and financial transactions you make in connection with the Game.
Game of Chance – No Guaranteed Outcomes: The Diamond Hands Game involves elements of chance (a raffle-style mechanism). There is no guarantee of winning any prize. Your odds of winning depend on the number of entries you obtain relative to total entries in a cycle. Do not spend funds you cannot afford to lose. Many participants will not win anything of value, and you should not expect to gain money or assets by playing.
Cryptocurrency Only – Volatility and Risk: All in-game transactions are conducted in Solana (SOL) cryptocurrency. Cryptocurrency markets are volatile, and the value of SOL or any in-game asset can fluctuate dramatically. We do not accept fiat currency (government-issued money) for participation. By using SOL, you acknowledge the inherent risks of cryptocurrency, including price volatility, transaction costs, and the possibility of loss. Ensure you understand how to use a Solana wallet securely. We will never ask for your seed phrase or private keys – stay vigilant against scams.
Blockchain and Technical Risk: The Game operates on the Solana blockchain via smart contracts. Blockchain transactions are irreversible and subject to the functionality of the Solana network. There is no guarantee of continuous, error-free operation of blockchain services. You accept the risk that smart contract code or blockchain technology could malfunction, be exploited, or fail, which may impact the Game’s outcome or your assets. The Company is not liable for losses due to technical failures, hacks, or network outages on the Solana network. In the event of a material technical issue, we reserve the right to suspend or cancel a game cycle and, if appropriate, refund entries.
Legal Compliance – Void Where Prohibited: The Game is accessible globally; however, not all jurisdictions permit games of chance or crypto-based sweepstakes. It is your responsibility to ensure that participating in the Diamond Hands Game is legal under your local laws. We make no representations that the Game is lawful in any specific location. The Game is void where prohibited or restricted by law. Participants are strongly encouraged to consult their local and state laws (especially regarding digital raffles, sweepstakes, and gaming) before playing. By entering, you confirm that you are not located in any country, state, or region where participation would violate any law or regulation.
No Purchase Necessary: No purchase is required to enter or win the Diamond Hands Game. A free entry method is available (see Section 8 below) in compliance with U.S. sweepstakes laws that prohibit mandatory purchases. Purchasing entries with SOL will not increase your chances of winning beyond what your number of entries represents.
Assumption of Risk: By participating, you assume all risks associated with the Game, including but not limited to the risks of using cryptocurrency, the chance of losing the SOL you spend on entries, and the possibility that the Game or any prize may yield no financial benefit. You agree that you understand these Terms and are participating voluntarily and at your own risk.
These important notices are highlights only. Please read the rest of the Terms for full details of your rights and obligations.
To be eligible to participate in the Diamond Hands Game, you must meet all of the following criteria:
Minimum Age: You must be 18 years of age or older (or the legal age of majority in your jurisdiction, if higher). Individuals under 18 are strictly prohibited from playing. The Company will not knowingly allow participation by minors, and any underage player will be disqualified and barred from the Game.
Legal Capacity: You must have the legal capacity to enter into a binding agreement. By accepting these Terms, you affirm that you are not barred from using cryptocurrency or participating in such games by any law.
Jurisdictional Restrictions: You must not be a resident of or physically located in any jurisdiction where participation in the Game is illegal or regulated to the extent that it would require licensing or registration that the Company has not obtained. This includes regions that prohibit online raffles, sweepstakes, or cryptocurrency gaming. Void where prohibited by law. It is your responsibility to verify that your local laws allow you to participate in a promotional game of chance using cryptocurrency. The Company reserves the right to restrict or reject participants from any jurisdiction if required by law or in its sole discretion for legal compliance.
One Account/Entry per Person: You may not create multiple identities or wallets to circumvent entry limits or eligibility rules. Each participant should use only one Solana wallet/account to enter the Game. Using multiple accounts or automated means to obtain entries is prohibited (see Section 9 on Prohibited Activities).
No Company Affiliates: Officers, employees, agents, and representatives of the Company (and its parent, affiliates, or partners), as well as members of their immediate families or households, may be prohibited from participating or from winning prizes, at the Company’s discretion. This is to ensure fairness and compliance with applicable laws.
By entering the Game, you represent and warrant that you meet all eligibility requirements above. The Company may require you to provide proof of eligibility (such as age verification, identity verification, or proof of residency) before awarding any prize. If you do not meet the eligibility criteria, or if you refuse to provide requested verification information, you may be disqualified and any potential prizes forfeited.
The Diamond Hands Game is a Web3 raffle-style game on the Solana blockchain where players obtain game entries (credits) for a chance to win prizes, notably a special non-fungible token (NFT) known as the “Diamond Key.” The Game draws inspiration from the “diamond hands” meme in cryptocurrency culture encouraging holding and long-term perspective but is presented as a fun, gamified experience rather than a serious investment venture.
How the Game Works:
The Game operates in recurring cycles (also called rounds or vault cycles). Each cycle has a defined start and end time. During a cycle, players can purchase or acquire entries (game credits) using SOL (the native token of Solana) to participate in that cycle’s draw. Entries function like raffle tickets: each entry gives the player one chance in the prize drawing for that cycle.
At the end of each cycle, the Game will determine winners according to the Game’s rules (e.g., through a random selection algorithm or smart contract). Typically, one grand prize winner is selected to receive the coveted Diamond Key NFT for that cycle. Additional prizes or outcomes may be specified for each cycle (for example, there may be secondary prizes or all participants might receive certain rewards, as communicated in the Game’s announcements for that cycle).
After a cycle concludes and winners are determined, the entries from that cycle expire and have no further use or value (they do not carry over into the next cycle). Each new cycle starts fresh, with all players at zero entries initially.
The Game incorporates lore and meme-themed elements for entertainment. It may involve narrative elements or community challenges, but fundamentally it remains a game of chance centered on acquiring entries and winning prizes.
Game Platform: The Diamond Hands Game is accessible through our website or decentralized application (dApp). To participate, you will need a Solana-compatible crypto wallet to connect to the Game. The interface will show the current cycle’s status (such as time remaining, total entries, and the growing prize “vault”).
The Vault: The Game may feature a communal prize pool or “Vault” denominated in SOL. A portion of the SOL spent on entries could be pooled into the Vault, which is used to fund prizes or in-game rewards. (For example, the Diamond Key may grant the winner access to a share of the Vault’s contents, as described further in Section 6.) The exact mechanics of how the Vault grows and how rewards are distributed from it will be transparently defined by the Game’s smart contracts and explained in the Game’s rules or FAQs for each cycle.
Transparency and Fairness: The Diamond Hands Game utilizes Solana smart contracts to handle critical game functions (such as entry tracking and random winner selection), aiming for a provably fair and transparent experience. Transaction records and relevant game data are recorded on the blockchain for transparency. While we strive to ensure fairness, by participating you acknowledge that the outcome of the Game is subject to chance and the integrity of the underlying technology.
Community and Meme Culture: As a meme-inspired game, community engagement is part of the experience. Players may be encouraged (but not required) to share memes, engage on social media, or follow the story of “Val” (the Game’s mascot or character). Any such activities are optional and meant to enhance fun. They do not materially affect your odds of winning unless explicitly stated as part of a promotion or contest.
This overview is provided for convenience. Specific details of each cycle (such as entry pricing, timing, and prize distribution) may vary and will be communicated through official channels (the Game’s website, app, or social media announcements). Always refer to the latest information provided for the current cycle.
Entries Defined: In the Diamond Hands Game, an “Entry” refers to a game credit or ticket that gives you a chance to win in the current cycle’s drawing. Entries may be purchased with SOL or obtained through promotions (including the free entry method in Section 8). Importantly, entries are not tokens or NFTs and are not blockchain-based assets; they are simply a numeric representation of your chances in the Game’s database or smart contract for that cycle.
No Lasting Value: Entries have no value outside of the Game and no enduring value at all. An entry is not a digital asset you own, but a one-time right to participate in the lottery-like drawing of the current cycle. Entries are not transferable or tradable, and they expire at the end of the cycle for which they were issued. Once a cycle ends, all unused or non-winning entries are nullified and do not roll over or carry into future cycles. You cannot cash out an entry or convert it back to SOL; once used to enter, the SOL is committed to the game pool (vault) for that cycle’s outcomes.
Purchasing Entries: To obtain entries (aside from the free method in Section 8), you will be required to send a specified amount of SOL per entry to the Game’s smart contract or through our interface. The current price (in SOL) for each entry or bundle of entries will be displayed in the Game interface. The Company reserves the right to change the entry price between cycles or offer discounts or promotions (e.g., bonus entries for buying a pack) at its discretion. All entry purchases are final – we do not offer refunds or cancellations once a blockchain transaction is confirmed. Be sure you intend to play before purchasing entries.
Entry Limits: The Company may impose limits on the number of entries a single participant can obtain in a cycle (to promote fairness and avoid excessive advantage by any one player). Any such limits will be disclosed (for example, “Maximum X entries per wallet per cycle”). Attempts to circumvent entry limits by using multiple wallets or identities is a violation of these Terms (see Section 9) and can result in disqualification.
No Fiat, Crypto Only: As noted, entries can only be bought with SOL cryptocurrency. We do not accept fiat currency (such as USD, EUR, etc.), credit cards, or other forms of payment directly. You are responsible for acquiring SOL from a third-party exchange or source if you wish to purchase entries. The Company does not sell SOL to users; you must obtain it on your own and transfer it to your personal wallet.
Transaction Fees: When purchasing entries, you may incur Solana network transaction fees (“gas” fees, which on Solana are typically minimal). These fees are not under our control and are charged by the network for processing your transaction. You are responsible for paying any such fees in addition to the entry cost. Entry purchases will only be counted after they are confirmed on the blockchain; if a transaction fails or is not confirmed by the end of the cycle, those entries might not be counted.
Confirmation of Entries: After you purchase entries, the Game interface should update to reflect your new total entries for the current cycle. In the event of any delay or discrepancy, the data recorded on the official Game smart contract shall prevail. You can always verify on-chain transactions via Solana blockchain explorers to see that your SOL was received by the Game’s contract. If you believe there is an error in the number of entries credited to you, contact us immediately at our support email (see Section 17) before the cycle ends, and we will investigate. We cannot adjust entries after a cycle’s draw has taken place.
By obtaining entries, you agree that you fully understand that an entry is not an investment, security, or tangible asset. It is a mere chance to win a prize in a game of chance, with no guarantee of reward. Entries have a zero redemption value – if you choose not to use them (or if they do not win), you receive nothing back.
The Diamond Hands Game features certain digital assets in the form of non-fungible tokens (NFTs) on the Solana blockchain that players may win or acquire. These NFTs have persistent functions or utility in the Game beyond a single cycle, distinguishing them from one-time entries. The key NFTs associated with the Game include Diamond Keys and Standard VAL NFTs, among others obtainable through “Empire Packs.” This section explains these assets and their role in the Game.
6.1 Diamond Key NFTs (Grand Prize)
The Diamond Key is a special NFT awarded as a grand prize in the Game. In each cycle, the primary winner will receive a Diamond Key NFT (either minted specifically for that cycle’s winner or transferred from the Game’s reserves). The Diamond Key is typically unique or extremely rare. It serves as a powerful in-game asset with ongoing benefits:
Persistent Utility: A Diamond Key NFT persists beyond the cycle in which it was won. Unlike entries, if you win a Diamond Key, it remains in your crypto wallet as your asset until you choose to use it or transfer it. Holding a Diamond Key may confer in-game advantages or rights in future cycles or the broader ecosystem. For example, a Diamond Key might grant the holder special access to “The Diamond Vault” or a claim to a portion of the vault’s SOL accumulated from game entries over time. (E.g., “Win a Diamond Key and get access to the Vault” as advertised.) The exact benefits of holding a Diamond Key will be determined by the Game’s design (and may evolve), but will be communicated to winners. Generally, not everyone can win a Diamond Key, but Diamond Key holders have privileges that others do not, potentially including the right to claim certain rewards.
Claim and Burn Mechanism: Diamond Key NFTs can be subject to a “claim and burn” mechanic. During designated claim periods, a Diamond Key holder might have the option to burn the Diamond Key NFT (permanently destroy the token on the blockchain) in order to claim a reward. For example, a claim period might occur at the end of a set of cycles or on a special date, where burning the Diamond Key yields a one-time SOL payout from the Vault or triggers some exclusive in-game event. Burning is optional – holders could also choose to keep their Diamond Key NFT for potential future benefits, but once a Diamond Key is burned for a claim, it is removed from circulation and cannot be used again. Instructions and terms for any claim/burn event (such as how to initiate the burn, the window of time to do so, and what reward is given) will be provided through official channels ahead of the claim period. The Company makes no guarantee of the market or redemption value of a Diamond Key – its value is primarily in-game utility and whatever reward is offered during claim events.
Transferability: As an NFT on Solana, a Diamond Key is generally transferable between wallets. You may sell or trade it on secondary markets (subject to any smart contract royalties or platform fees). However, be aware that the in-game utility of a Diamond Key (including the right to claim rewards) will only apply to the wallet that currently holds it. If you transfer your Diamond Key to someone else, you transfer all its in-game rights to them. The Company is not responsible for any loss or outcome from trading NFTs – do so at your own risk. Also note that only the original Diamond Key NFTs issued by the Game carry the official game utility; any attempt to use a fraudulent or unrelated NFT with similar name will not be recognized.
6.2 Standard VAL NFTs (Empire Pack NFTs)
“Standard VAL NFTs” refer to another category of NFTs within the Diamond Hands Game ecosystem. These are often obtained by players through the purchase of Empire Packs or through other in-game achievements. An Empire Pack is essentially a bundle or loot-box within the Game that, when opened or minted, grants the player certain NFTs or items. Standard VAL NFTs are one such item that can emerge from Empire Packs. Key points about Standard VAL NFTs:
Persistent In-Game Function: A Standard VAL NFT, once minted to your wallet, serves a role in the game that persists across multiple cycles. For instance, holding one (or a set) of these NFTs might yield benefits such as bonus entries in each cycle, increased odds in drawings, eligibility for special side-draws, or a share in distributed rewards from the Vault. The specific function might be that all Standard VAL NFT holders can claim a portion of the Collection Vault’s contents periodically, or it might grant voting rights in community decisions, etc. (The “VAL” in the name suggests it is tied to the Store of Value ($VAL) concept, perhaps representing a stake in the ecosystem’s value.) Details of the utility will be provided in the Game’s documentation. The important part is that these NFTs do something in the context of the Game’s ongoing operation – they are not mere collectibles.
Obtaining Empire Packs and VAL NFTs: Empire Packs may be purchased using SOL or possibly using a native token (if the Game has its own token like $VAL) as specified. When you purchase an Empire Pack, it will trigger the minting of one or more NFTs to your wallet. One of these could be a Standard VAL NFT (among possibly other types of NFTs or game items). Each Empire Pack has set odds or contents defined (and possibly published for transparency). There is no guarantee that a given pack will contain a Standard VAL NFT; it might be one of several possible outcomes.
Claim and Burn: Similar to Diamond Keys, Standard VAL NFTs can also be subject to claim-and-burn events. During certain claim periods, holders of Standard VAL NFTs might be allowed to burn some or all of their Standard VAL NFTs to claim rewards (such as SOL payouts from the Vault, or upgraded NFTs, etc.). For example, the Game might announce that “during the claim week, each Standard VAL NFT can be burned to claim X SOL or a special edition NFT.” The rules for any such event will be disclosed in advance. If you choose to burn your Standard VAL NFT, it will be destroyed and removed from your wallet permanently, and you’ll receive whatever reward is specified. If you do not burn it, you keep the NFT and can continue to enjoy its ongoing utility in the game, but you might forfeit that cycle’s particular reward. The option to burn is up to the player; the Game will not automatically burn your NFTs.
No Independent Monetary Value: While Diamond Keys and Standard VAL NFTs may have marketplace value (since they are NFTs you can hold or trade), their primary designed value is in their Game functionality. The Company does not guarantee any floor price or market for these NFTs. Their worth in real-world monetary terms is speculative and driven by player demand. We caution players not to purchase Empire Packs or NFTs for speculative investment purposes. Only obtain these NFTs if you want to participate in the Game’s ecosystem and understand their intended in-game use. Outside of any official claim events, these NFTs do not automatically entitle you to any payout – for instance, just holding a Standard VAL NFT might yield some in-game perk, but it does not mean the Company owes you money. Any rewards are conditional on in-game events or smart contract functions, not perpetual obligations.
6.3 Other Digital Assets:
The Game may introduce other types of NFTs or tokens as it evolves (such as special edition NFTs, achievement badges, or perhaps a fungible token like $VAL if one exists). Any such assets and their terms of use will be described in updates to these Terms or in specific rules at the time of their introduction. If a $VAL token (Store of Value token) exists in the ecosystem, note that its use may be governed by additional terms or token-specific disclaimers (often, projects will clarify that their token is not an investment and so on). At this time, however, entries in the Diamond Hands Game are in SOL only, and any mention of $VAL token in our marketing is separate from the Game’s entry mechanism.
6.4 No Security or Ownership Interest:
We reiterate that none of the Game’s NFTs or digital assets represent an ownership interest in the Company, the Game, or any pool of funds. They are not stocks, not bonds, and not guarantees of profit. They are game pieces designed for entertainment and promotional purposes. Even if, for example, a Diamond Key NFT allows you to claim some SOL from the Vault, that is done as part of the game mechanics and not because the Diamond Key is a share of a fund or revenue. We make this distinction to comply with laws and to ensure players understand the nature of what they hold.
6.5 Player Responsibilities with NFTs:
If you win or purchase any NFT through the Game, it will be delivered to your Solana wallet. You are solely responsible for managing and securing your NFTs. The Company does not custody these assets on your behalf; once delivered, they are under your control. Be sure to use a secure wallet and never share your private keys. If you lose access to your wallet or accidentally send your NFT to an incorrect address, the Company cannot recover it for you. Also, some NFTs might require you to take action to realize their benefits (e.g., initiate a claim during a window). The Company will attempt to notify or remind holders of such events via our official channels, but ultimately it is the player’s responsibility to stay informed. We recommend following our official Twitter/X account and joining any community channels for announcements.
All transactions related to the Diamond Hands Game – including purchasing entries, buying Empire Packs, and receiving payouts or prizes – are conducted exclusively in Solana (SOL) cryptocurrency. By participating, you agree to the following terms regarding payments and transactions:
7.1 SOL as the Exclusive Currency:
The Game does not support fiat currency (such as USD, EUR, etc.) for any purchase or entry. You cannot pay with credit cards, bank transfers, cash, or any form of fiat; only SOL is accepted. Likewise, prizes are generally awarded in SOL or in NFTs; no prize will be given in fiat currency. Ensure that you have a compatible Solana wallet loaded with sufficient SOL before attempting to participate.
7.2 Wallet Requirement:
To send or receive SOL and NFTs, you must use a Solana blockchain wallet (for example, Phantom, Solflare, or others) that you control. The wallet is necessary to connect to the Game’s dApp for buying entries and to receive any NFT prizes. You are responsible for all aspects of managing your cryptocurrency wallet, including safeguarding your private keys and recovery phrases. The Company never takes custody of your funds directly – any SOL you spend goes from your wallet to the Game’s smart contract or treasury wallet, and any SOL prizes are sent from the Game’s wallet to yours.
7.3 Transaction Finality:
Transactions on the Solana blockchain are irreversible once confirmed. When you send SOL to purchase entries or packs, there is no undo button – we cannot cancel or refund an on-chain transaction after the fact. If you believe you made an error (such as sending the wrong amount or to the wrong address), notify us immediately; while we cannot reverse a transaction, we might help resolve certain mistakes if the funds are retrievable and if contacted promptly. However, we do not guarantee any refunds. All sales are final.
7.4 Network Fees and Costs:
Performing actions on the blockchain (sending SOL, minting an NFT, etc.) typically incurs a small network fee. On Solana these fees are usually very low (fractions of a cent), but they do exist. You are responsible for paying any such network fees. The Game’s smart contracts are designed to minimize extra costs, but if you engage in an action that requires a fee (for example, minting an Empire Pack NFT), that fee will either be deducted automatically from the transaction or you will need to approve it via your wallet. The Company does not receive these fees; they go to Solana network validators.
7.5 Price and Exchange Rate Considerations:
All prices for entries or packs are set in SOL, not in fiat. We may reference approximate fiat values for convenience in communications, but the binding price is in SOL. We do not adjust entry prices based on fiat exchange rate fluctuations. If the value of SOL changes, that is part of the risk you accept using cryptocurrency. For example, if 1 entry costs 0.1 SOL, and SOL’s price doubles or halves in USD terms overnight, the SOL price per entry remains 0.1 SOL unless we explicitly change it for future cycles. Similarly, any SOL prizes you win may change value relative to fiat by the time you use them; we do not compensate for such changes.
7.6 Fraudulent or Unauthorized Transactions:
You must only use funds that you lawfully own to participate. If any transaction is flagged or determined to be fraudulent, unauthorized, or made through the use of hacked/stolen assets, the Company reserves the right to void the associated entries and refuse to award prizes. This is both to protect the integrity of the Game and to comply with legal and ethical standards (e.g., anti-money laundering rules). We cooperate with blockchain analytics and law enforcement if illicit activity is detected.
7.7 Payment Errors and Reversals:
In the unlikely event that a payment error occurs on our side (for example, you were charged the SOL but did not receive entries due to a smart contract bug, or you were due a SOL payout that failed to send), the Company will investigate and correct the mistake as needed. This may involve crediting you the missing entries, sending the owed payout, or in some cases issuing a refund of SOL. Any corrections will be done in SOL or equivalent value in SOL; we will not issue fiat as remedy. You must report any such issues within a reasonable time (ideally immediately, and no later than 14 days after the incident) to be eligible for correction.
7.8 Tax and Financial Responsibility:
The Company makes no representations about tax implications of your transactions. Any value you receive (SOL payouts, NFT rewards that you sell, etc.) may be considered taxable income in your jurisdiction. You are solely responsible for tracking and reporting any taxes (income, capital gains, etc.) that result from your participation in the Game. The Company will not provide tax advice. If required by law (for example, for U.S. residents winning above certain thresholds), we may ask for tax identification information and issue relevant tax forms, but generally with cryptocurrency prizes, that is not automated. Keep records of your buys and wins for your own tax filings.
7.9 No Interest or Investment Return:
Any SOL you commit to the Game (like spending on entries) does not earn interest and is not returned to you (except if you win something by chance). The pooled SOL in the Vault remains property of the Game’s mechanism and eventual winners, not the players who bought entries. Purchasing entries is spending, not investing or saving. Please understand this distinction clearly to avoid any misunderstanding – the Game is not a DeFi yield farm or bank account; it’s more akin to buying lottery tickets, where your spent money is gone unless you win.
By proceeding with any payment or transaction for the Diamond Hands Game, you agree to the above terms and acknowledge the risks inherent in using a cryptocurrency-based platform.
While the Diamond Hands Game allows the purchase of entries with SOL, no purchase is necessary to enter or win. We provide a free alternate means of entry (AMOE) in compliance with legal requirements for sweepstakes. This free entry option ensures that anyone can participate in the Game without spending any money or cryptocurrency, maintaining the Game’s status as a promotional game of chance rather than an illegal lottery.
8.1 Free Entry Eligibility:
The free entry method is available to any individual who meets the standard eligibility requirements (see Section 3) for participating in the Game (e.g., 18+ years old, not in a prohibited jurisdiction). Even if you have already purchased entries, you may still use the free entry method (subject to the limit of one free entry per cycle per person, as described below). There is no discrimination in winner selection between purchased entries and free entries – a free entry has an equal chance of winning as any other single entry.
8.2 How to Obtain a Free Entry:
To enter the current cycle for free, participants may follow these steps (our “Free Entry Promotion”):
Social Media Participation: Create a post on the social media platform X (formerly Twitter) to help promote the Game. Specifically, you must like and retweet the official Diamond Hands Game cycle announcement or another designated post by our official account, and tag 3 friends in your retweet or in a reply to the post. This demonstrates community engagement and helps spread the word in lieu of a monetary entry fee.
Screenshot Proof: Take a screenshot showing that you have completed the above actions (the liked/retweeted post with your tags visible).
Email Submission: Email the screenshot to info@valmeme.com with the subject line “Diamond Hands Free Entry – [Cycle X]” (where [Cycle X] is the current cycle number or name). In the body of the email, include:
Your Solana wallet address (the address that will receive the free entry credit).
Your X/Twitter handle (so we can verify the social media action).
A brief statement confirming you meet the eligibility requirements (e.g., “I am over 18 and eligible to participate under the Terms and Conditions.”).
Timing: The email must be received by us during the active entry period of the current cycle. We recommend sending the email at least a few hours before the cycle’s close to ensure processing. Late submissions (after the cycle’s entry deadline) will not be counted for that cycle, though they might be considered for the next cycle at our discretion if applicable.
By completing these steps, you will be considered for a free entry into the current cycle of the Game. Upon our review and verification of your submission, we will credit one (1) entry to the provided Solana wallet address for the ongoing cycle.
8.3 Limitations and Conditions:
One Free Entry Per Cycle: Each participant (each person, household, or account) may obtain at most one free entry per cycle using this method. Multiple submissions in the same cycle or attempts to get multiple free entries (e.g., by using multiple email addresses or social accounts for one person) are not allowed. The first valid submission we receive from you will be the one counted. Additional or duplicate submissions will be disregarded, and excessive attempts may result in disqualification.
Valid Social Interaction: The social media post must be genuine and remain up at least through the cycle’s end. If your post is deleted or your like/retweet is undone before the cycle ends, your free entry may become void since we won’t be able to verify it. Ensure your account is public (or at least that @storeofval or our officials can see it) so we can verify the tags and retweet. We will not use your social media content beyond verification and perhaps acknowledging community participation.
Email Verification: The email must be sent to the correct address (info@valmeme.com). We are not responsible for misdirected emails, technical issues, or submissions that we do not receive. You should get an auto-reply confirmation or a manual confirmation once we process your submission. If you do not receive any confirmation, you can attempt to re-send or contact support, but do not spam multiple entries.
Deadline Adherence: “Free” entries received after the cutoff time for a cycle will be void for that cycle. We will try to process all free entries promptly, but any that come in when the cycle is already in drawing or closed will not be included. We do not carry over free entry requests to the next cycle; you would need to re-submit for each cycle if you wish to keep entering for free.
No Purchase Necessary Law: Offering this free entry method means no purchase or payment is required to participate or win in accordance with U.S. sweepstakes laws. Your odds of winning with a free entry are the same as the odds of a paying participant with one entry; purchasing more entries only increases a person’s number of chances but does not change each chance’s likelihood of winning.
Equal Treatment: Once granted, a free entry is functionally identical to a paid entry in the draw. We (and our smart contract) do not differentiate when selecting winners – a random draw could just as likely pick a free entry as any other. The winner selection process is thus fair to those who utilize the free method.
8.4 No Obligation and Promotional Use:
Using the free entry method does not obligate you to any purchase later. It is truly free. The social media engagement we request is optional; if you do not use social media, we may specify an alternate free entry method (such as mailing in a request) in future official rules. But for online ease, the social media/email method is our current AMOE. By participating in the free entry method, you give us permission to mention your social media handle as a participant in promotional contexts (for example, we might tweet “Welcome our new players!” and list some handles) – but we will not share your personal details publicly.
8.5 Abuse of Free Entry:
Any attempt to abuse the free entry system – for instance, creating dozens of fake social media accounts or sharing misleading promotions – is strictly prohibited. The Company reserves the right to disqualify any individual we suspect of gaming this free entry process or not fulfilling its requirements in good faith. We also reserve the right to modify or cancel the free entry promotion if it becomes technically unfeasible or compromised (though we must always provide some no-purchase method to stay legal, it might change form if needed).
In summary, the free entry method is our way to ensure everyone has a shot at playing without financial barriers. We encourage you to take advantage of it if you’re interested in the Game but don’t want to spend SOL. No purchase or payment is necessary to have a chance to win – a core principle we uphold.
We expect all participants to play fairly and respect the spirit of the Diamond Hands Game. By using our services, you agree not to engage in any of the following prohibited activities, and you acknowledge that violation of these rules may result in consequences including the forfeiture of entries or prizes, suspension of your participation, or banning from future cycles:
9.1 Cheating and Fraud: You must not cheat or defraud the Game in any way. This includes, but is not limited to, exploiting bugs or vulnerabilities in the website or smart contracts, using any sort of script or bot to gain an unfair advantage (such as automating entry purchases beyond normal limits or automating the free entry process), colluding with other players to manipulate outcomes, or providing false information to the Company (e.g., fake identities, multiple email addresses or wallets pretending to be different people for more free entries).
9.2 Multiple Accounts: Only one account (wallet) per person is allowed for participation. Creating or controlling multiple Solana wallets to obtain additional entries beyond the set limits, or to claim multiple free entries, is prohibited. If we detect that multiple wallets are controlled by the same individual for the purpose of evading limits or increasing odds unfairly, we may disqualify all associated accounts and void their entries. (It’s fine to have multiple wallets for personal reasons, but do not use more than one to enter the same cycle of the Game.)
9.3 Circumventing Security: Do not attempt to hack, DDoS, or disrupt the operation of the Game or its smart contracts. Any attempt to interfere with the Game’s servers, database, blockchain transactions, or other technology is strictly forbidden. This includes attempting to falsify transaction records, attempting to predict or manipulate random outcomes (for example, if the draw is on-chain, trying to influence the randomness), or overwhelming our systems to cause malfunctions.
9.4 Unauthorized Access: You may not attempt to gain unauthorized access to any account, wallet, or data that is not your own. This includes trying to intercept communications, steal other users’ private keys or personal information, or using any phishing or social engineering to trick others. Impersonating the Company or its staff to other users is also forbidden.
9.5 Misuse of Communications: If the Game offers any community forums, chats, or social media groups, you must follow proper etiquette. Harassment, hate speech, spamming, or posting malicious links is not allowed. While this may be outside the scope of game mechanics, toxic behavior can lead to community bans and indirectly affect your participation if severe. Keep communications related to the Game respectful and lawful.
9.6 Compliance with Promotional Rules: If the Company runs any additional promotions, giveaways, or contests (like a social media contest or referral program), you must adhere to the specific rules of those events as well. Any attempts to cheat those (for example, using fake accounts for a referral bonus) will also be considered a violation of these Terms.
9.7 No Resale of Entries: You are not permitted to sell, trade, or barter Game entries to any other person. Entries are tied to the wallet that obtained them and are not transferable (as Section 5 explains). Any purported sale or transfer of an entry is void and will not be honored by the Game. Similarly, you should not accept or attempt to buy entries from others – the only legitimate ways to get entries are through the official Game interface or the free entry method.
9.8 NFT Use in Game Only: While you are free to trade your NFT prizes (Diamond Keys, Standard VAL NFTs, etc.) externally, you must not use them or any derivatives to create confusion or malicious schemes. For instance, do not create fake “Diamond Hands” NFTs and sell them, claiming they have game benefits; do not impersonate our NFTs or misuse our trademarks. Such activities can lead to legal action beyond just a ban from the Game.
9.9 Follow Applicable Laws: You must not use the Game for any illegal purpose. This Game should not be used as a means for money laundering, terrorist financing, or any illicit financial activity. Also, you should not play if you are under any legal restriction (such as a court order) that would prevent you from participating in games of chance. Compliance with all relevant laws (including those related to gambling, sweepstakes, crypto trading, etc.) is required from your side.
Enforcement: The Company reserves the right to monitor gameplay and blockchain transactions for signs of prohibited conduct. This can include analysis of entry purchases, IP address checks, KYC (Know Your Customer) procedures if fraud is suspected, and other investigative steps. If a violation is detected or suspected, we may take one or more of the following actions:
Cancel or void some or all of your entries (with no refund).
Disqualify you from the current cycle or future cycles.
Forfeit any prize you might have won or would have been eligible to win. (If a prize has already been distributed, we may take legal steps to reclaim it if fraud is proven.)
Ban your wallet address from interacting with the Game’s smart contracts.
Involve law enforcement or other authorities if the behavior violates law (e.g., hacking, fraud).
We will act fairly and reasonably in enforcing rules. If there is a suspected issue, we may reach out to you for an explanation before taking action, when feasible. However, blatant or dangerous violations (like attacking the contracts) may result in immediate action without notice.
Remember, the integrity and fun of the Game rely on everyone playing fair and square. Prohibited activities not only harm other players but could jeopardize the whole project. We appreciate your cooperation in keeping the Diamond Hands Game a positive and honest community experience.
Because the Diamond Hands Game is built on a decentralized blockchain platform, you as a user bear full responsibility for the security of your cryptocurrency wallet and accounts. The Company does not have custody of your assets or control over your transactions; we simply provide the smart contract interface for the game. It is crucial that you understand and agree to the following:
10.1 Your Wallet, Your Responsibility: You must use your own Solana wallet (e.g., a self-custody wallet like Phantom) to interact with the Game. Keep your wallet credentials secure. Never share your wallet’s private key or seed phrase with anyone, including us. The Company’s personnel will never ask you for your private keys or seed phrase – if anyone claiming to be support does so, it is a scam. If you divulge your keys, you risk losing all your assets. We cannot recover stolen funds or NFTs if your wallet is compromised.
10.2 Beware of Phishing: Only use official links and sources to access the Diamond Hands Game. Double-check the URL (our official site or app) and be cautious of look-alike websites or fake social profiles that might trick you into connecting your wallet. If you connect your wallet to a malicious site, they might drain your funds or steal your NFTs. The Company is not liable for losses due to phishing or user security lapses. Always ensure you are interacting with legitimate domains and smart contracts. When in doubt, obtain links from our official communications (Twitter/X account @storeofval, our website announcements, etc.).
10.3 Transaction Review: When your wallet prompts you to approve a transaction (whether it’s purchasing entries, minting an NFT, or burning a token), review the details carefully. Make sure the transaction is going to the correct contract address (the Diamond Hands Game contract or relevant address we provided) and that you understand what you are approving. If something looks unfamiliar or suspicious in the wallet prompt, cancel and double-check. For example, a transaction that requests an unusual permission (like unlimited spending) should be scrutinized – our entry purchase transactions will typically be straightforward SOL transfers or contract calls with known parameters.
10.4 No Password Recovery: The Company has no ability to reset your wallet password or recover a lost private key. Blockchain accounts are controlled solely by you. If you lose access to your wallet (lost keys, forgotten seed phrase, etc.), we cannot help you regain access or retrieve any assets in that wallet. This includes any entries or NFTs associated with that wallet. If you lose your Diamond Key NFT because you lost your wallet, we cannot reissue you a new one – we have no way to verify that claim without the cryptographic proof of the wallet. Guard your credentials accordingly, and consider backing up your seed phrase in a secure offline manner.
10.5 Public Address and Privacy: Your Solana wallet address is public by nature of blockchain technology. When you participate, your address may be visible on leaderboards, winner announcements (we might partially obscure for privacy, but on-chain it’s visible to anyone), and in the transaction history. If you prefer pseudonymity, note that we might reference your address or an abbreviated form in public communications (e.g., “Winner: wallet ...5Fd8 won the Diamond Key!”). This is inherent to the transparency of blockchain – keep in mind that your on-chain actions are public data.
10.6 Use of Third-Party Wallet Services: If you choose to use a third-party custodial wallet or exchange wallet (not recommended for Web3 dApps), be aware that you might not actually control that wallet’s keys and such services might not support interacting with our Game contracts or receiving NFTs. It’s strongly recommended to use a personal, non-custodial wallet for the Game. The Company is not responsible if a third-party service prevents you from receiving a prize or if they freeze your assets; any such issues must be resolved between you and that service.
10.7 Reporting Security Issues: If you suspect that your wallet has been compromised or that there has been any unauthorized activity related to the Game (for example, you see entries being used that you didn’t purchase, or an NFT prize is transferred out without your action), you should act quickly. Secure your accounts (move remaining funds to a new wallet if possible) and notify us at once. While we cannot undo blockchain transactions, we may be able to freeze an ongoing cycle or flag a scam if we catch it in time, and we can at least assist you in understanding what happened by analyzing the blockchain. Prompt reporting is key.
In summary, you are in control of and responsible for your own wallet and transactions. Decentralization empowers you with control, but also with the risk that comes from that control. By participating, you acknowledge that the Company has no liability for issues arising from your management of your wallet, and you agree to exercise all due caution to protect your own digital assets.
Participating in the Diamond Hands Game means that you are engaging in an activity that comes with significant risks and uncertainties, especially given its basis in cryptocurrency and chance. By entering the Game, you explicitly acknowledge and accept the following risks:
11.1 No Guarantee of Winning or Profit: You understand and accept that the Game is fundamentally a game of chance. There is no guarantee that you will win any prize or receive any return on the SOL you spend. Most participants will not win the grand prize in any given cycle, and some may not win anything at all. You should not view the money spent on entries as an investment – it is an entertainment expense, akin to buying a movie ticket or a traditional lottery ticket, with the possibility (but not promise) of a reward.
11.2 Volatility of Crypto Assets: The use of SOL and NFTs means that even if you do win a prize, the value of that prize in fiat terms can fluctuate. Cryptocurrencies and NFT markets are highly volatile. The SOL you win today could be worth less (or more) tomorrow. The Company has no control over market dynamics. You agree that you will not hold the Company responsible for changes in the value of SOL, $VAL token (if applicable), or any NFT over time. There is also a risk that Solana’s value could drop significantly, or that the SOL economy faces regulatory or technical issues impacting its usability or value.
11.3 Regulatory and Legal Risks: The regulatory environment for cryptocurrency and online gaming is evolving. You acknowledge the risk that changes in laws or regulations (or their interpretation) could adversely affect the Game. For example, a new law might classify certain crypto games as gambling or require licensing. The Company might have to modify or even halt the Game in certain jurisdictions or altogether to comply with laws. You accept this risk and understand that such changes are beyond the Company’s control. We will try to adapt if possible, but there may be scenarios where continuing the game as-is is impossible due to legal constraints.
11.4 Technology and Security Risks: There are inherent risks in using cutting-edge technology:
Smart Contract Risk: The Game runs on smart contracts. While we have tested and audited these to the best of our ability, smart contracts can have bugs or vulnerabilities. Hackers could exploit unforeseen flaws to affect game outcomes or steal funds from the Vault or participants. By participating, you accept the risk of smart contract failure or exploitation. If such an event occurs, it could result in loss of your entries, or the prize pool, or a wrongful distribution of rewards.
Network Congestion or Failure: The Solana network might experience congestion, downtime, or even critical failures. If the network is down or heavily congested at a crucial time (e.g., when a cycle is ending or when claims are happening), this might interfere with gameplay – entries might not go through in time, transactions may fail, etc. We might delay draws or take other steps in response, but you accept the risk that technical issues could impact your ability to participate or win.
Wallet Security: As discussed, if your wallet is compromised, you could lose everything in it. That risk is on you as the user. Similarly, if you mistakenly send funds to the wrong address or sign a malicious transaction, those are user errors that can result in loss. The system is designed to be safe if used correctly, but the ultimate control (and thus risk) lies with you.
11.5 Economic Risk and Gas Fees: Participating in the Game isn’t free of incidental costs – you will pay small transaction fees (gas) on Solana. While minor, if the network ever becomes congested or fees spike, you could pay more than anticipated. Additionally, the Game’s economics (like how the Vault grows or what an NFT can be sold for) are not guaranteed. You could burn a Diamond Key expecting a certain payout, but maybe the Vault is smaller than hoped. There is no guaranteed minimum prize unless explicitly stated for a given cycle.
11.6 Community and Market Hype: The Game may be surrounded by hype, discussions, or speculation (especially given the meme culture aspect). You should not let FOMO (fear of missing out) or community hype cloud your assessment of these risks. Don’t risk funds you can’t afford to lose. If some players tout big wins or high returns, remember that results can vary greatly and the risk of losing is ever-present. The Company encourages responsible participation.
By accepting these Terms, you confirm that you understand the above risks and are willing to proceed despite them. You take full responsibility for your actions within the Game and their outcomes. The Company disclaims liability for these inherent risks (as detailed further in Section 12 and 13 below). We want players to have fun, but we also want them to be clear-eyed about the risks in this novel crypto gaming environment.
If you do not understand or cannot accept these risks, do not participate in the Diamond Hands Game.
To the fullest extent permitted by applicable law, the Company (and its officers, directors, employees, agents, affiliates, and partners) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever, including but not limited to damages for lost profits or revenues, loss of data, loss of goodwill, opportunity costs, or other intangible losses, arising out of or related to your access to or use of (or inability to access/use) the Diamond Hands Game or any services or content provided in connection with the Game. This limitation of liability applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
Specifically, and without limiting the generality of the above, the Company will not be liable for:
Financial Losses: Any loss of cryptocurrency or funds that you incur in connection with the Game, whether due to not winning a prize, due to market value changes, or due to errors or delays. We do not guarantee any earnings or reimbursement for expenses.
Technological Failures: Any harm or loss resulting from technical issues such as smart contract bugs, blockchain malfunctions, server downtime, or data loss. The Company is not responsible for glitches or errors in the Game software or infrastructure that result in lost opportunities or corrupted outcomes.
Security Breaches: Any unauthorized access to or use of your wallet or our servers, and any data breach or theft of personal or financial information. While we commit to maintaining reasonable security measures, blockchain participation means certain data (like your public address and transactions) is inherently public. Additionally, we cannot guarantee that our website or dApp is 100% secure from hacking or viruses, though we take precautions.
User Errors: Any mistakes you make, such as sending SOL to the wrong address, mismanaging your private keys, or misunderstanding Game instructions. The Company cannot be liable for the consequences of user error.
Third-Party Services: Any actions or inactions of third-party platforms or services we don’t control. For example, if you use a particular wallet app or a crypto exchange and there’s an issue on their end (like the wallet app malfunctions or the exchange freezes withdrawals), we are not responsible for those external issues. Similarly, if a third-party (like a social media platform) is needed for participation (as in the free entry method) and they experience downtime or account issues, that’s beyond our control.
Legal and Regulatory Events: Any losses or damages resulting from changes in law, regulation, or government action that impact the Game (such as a directive to cease operations in a region, or a legal claim that shuts down certain features). This also includes if we have to void or modify parts of the Game to comply with legal orders – we won’t be liable for the impact that has on you (for instance, if a cycle is canceled due to legal risk, we’ll attempt to refund entry purchases, but we won’t be liable for any disappointment or lost expected value).
Consequential Damages: Any indirect consequences of the above – for example, if you couldn’t cash out a prize in time and missed another opportunity, or if participating in the Game caused you psychological distress – we do not accept liability for these types of harms.
Cap on Liability: To the extent that the law does not allow the complete exclusion of liability as stated above, and notwithstanding anything else in these Terms, in no event will the Company’s total cumulative liability to you for any claims arising out of or relating to these Terms or the Game exceed the greater of: (a) the total amount of fees (if any) you paid to the Company for participation (i.e., your expenditure on entries) in the 6 months preceding the claim, or (b) $100 USD (one hundred US dollars) (or equivalent in your local currency). This cap applies in aggregate for all claims you might have against the Company, meaning it is the maximum we would pay for all claims put together, not per claim.
Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above disclaimers or limitations may not apply to you in part or in whole. In such jurisdictions, the liability of the Company shall be limited to the greatest extent permitted by law.
Release: You hereby release and forever discharge the Company and its affiliates, and their respective officers, directors, employees, and agents, from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with disputes between you and any other user or third party in connection with the Game. For example, if you have a dispute with another player (say, over a trade or something outside our platform), that’s between you and them, not involving us.
By participating in the Game, you acknowledge and agree that the above limitations of liability are reasonable and part of the risk allocation set forth in these Terms. The pricing of any entries (if any fee is charged) and our decision to offer the Game would be different if we had to assume more liability.
The Diamond Hands Game and all related services, content, and software are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted under applicable law, the Company disclaims all warranties, representations, and conditions of any kind, whether express, implied, or statutory, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Without limiting the generality of the foregoing, we do not warrant or guarantee:
13.1 Continuous, Error-Free Operation: We make no warranty that the Game or any related services (website, dApp, smart contracts, etc.) will be uninterrupted, timely, secure, or error-free. There may be delays, omissions, downtimes, or inaccuracies in the Game’s functionality or results. We cannot guarantee that our software or smart contracts are completely free of bugs, vulnerabilities, or code errors, though we have taken reasonable steps to test and secure them.
13.2 Accuracy of Information: Any information, statistics, or data presented in the Game or on our website (for example, real-time entry counts, prize pool sizes, odds, past winners, etc.) are provided for convenience and may not always be accurate or up-to-date. While we strive for accuracy, we do not warrant the truth or completeness of any information made available through the service. Use any such information at your own risk. Official results are determined by the Game’s actual outcomes (which may be verifiable on-chain) and will be the final word in case of any discrepancy with displayed information.
13.3 Fitness for Purpose: We do not warrant that the Game will meet your expectations or requirements. For example, we don’t guarantee that participating will be fun or profitable for you, or that the Game’s format will suit your preferences. It is possible the Game changes over time (format, rules, visuals), and we don’t warrant that it will remain as initially presented.
13.4 Security and Virus-Free Use: We do not guarantee that the Game’s platform will be free of viruses, malware, or other harmful components. Although we take security seriously, any data transmitted through the internet (including crypto transactions) is inherently at risk. You are responsible for securing your own systems and scanning for issues. The Company disclaims any liability for harm to your computer system, software, or data from your use of our service or any external links on it.
13.5 Third-Party Content: If our Game or website displays or references any third-party content (like tweets, oracles data, or if we link to external sites), we provide no warranty for that content. Third-party materials belong to their respective owners and are used at your own risk. For instance, if we embed a price feed for SOL or a Twitter feed for community posts, we don’t vouch for its accuracy or safety.
13.6 Implied Warranties: Any implied warranties that cannot be disclaimed are, where allowed, limited in duration to a period of thirty (30) days from your first use of the Game. After that, no implied warranties shall apply. (In some places, implied warranties can’t be disclaimed at all; in others they can be for software; this clause is a general protective measure.)
In summary, you use the Diamond Hands Game at your own risk. No advice or information, whether oral or written, obtained from the Company or through the Game, shall create any warranty not expressly stated in these Terms. We do not guarantee that the Game will be free from human or technical error, and we do not promise any specific results from participation except those that flow from the game rules (and even those could be subject to error in extreme cases, which we would endeavor to fix without warranty).
If you are dissatisfied with the Game or any aspect of our service, your sole remedy is to stop using the Game. We hope you enjoy the experience, but we need to make clear that we cannot insure you against all potential issues. The disclaimers and limitations given in these Terms are fundamental to our offering of this Game.
Protecting user data and ensuring transparency about data usage is important to us. However, as a Web3 application, the Diamond Hands Game handles data differently from traditional apps. This section details our approach to privacy and data, and provides disclosures typical of Web3 platforms:
14.1 Public Blockchain Data:
By using the Game, you understand that your transactions and interactions are recorded on the public Solana blockchain. This data is by design open and transparent to anyone with internet access. Information such as your wallet addresses, the amount of SOL you spend on entries, the NFTs you win (and when you transfer or burn them), and any SOL payouts you receive are all publicly visible on the blockchain ledger. We do not have the ability to alter or erase this on-chain information. Blockchain data is not considered “personal data” in the traditional sense (as it’s typically pseudonymous), but if your wallet address is linked to your identity in any way (for example, you publicly announce which wallet is yours), that data effectively becomes associated with you.
14.2 Personal Information Collection:
The Game itself can be played without providing us personal information (since entry purchase is via blockchain, and prizes are distributed via blockchain). However, there are scenarios where you might provide personal data:
Free Entry Submission: As described in Section 8, if you participate via the free entry method, you will send us an email that includes your email address, a screenshot of a social media action, and possibly a social media handle (and implicitly any personal data visible in that screenshot or associated with your email). We will use this information solely to verify your free entry and record your entry. We may keep the email on file as proof of the no-purchase entry for legal compliance reasons. We will not use your email or social handle for marketing purposes unless you have given us permission separately. We also won’t share that info with third parties except as needed for verification or legal reasons.
Customer Support or Contact: If you contact us (via email or other channels) for support or inquiries, we will receive whatever info you provide (like email address, name if provided, description of issue). We will use that information only to assist you and improve the service. Support requests might be logged, and if a resolution is found, we may publish an anonymized FAQ or note for the community if relevant, but we will not publish your personal details.
KYC (Know Your Customer) if Required: Generally, for an online sweepstakes with relatively small prizes, we do not anticipate requiring identity verification. However, if you win a prize above a certain threshold or if required by law (for example, U.S. law might require winner affidavits for high-value prizes, or tax reporting), we might request additional information like your full name, address, proof of age, and tax ID to ensure eligibility and compliance. This would usually apply only to substantial prizes (if the Vault becomes very large, for instance). We will securely collect and store such information only as long as needed for legal compliance (e.g., filling out a 1099 form in the US) and will restrict access to it.
14.3 Usage Data and Analytics:
We may collect non-personal usage data about how users interact with our website or app. This could include data like page views, button clicks, time spent, event logs (e.g., “user connected wallet” or “user purchased entries”), and technical info like browser type or device. We use this data to analyze and improve our service (for example, to see if a certain page is confusing users or if there are errors happening). If we use any third-party analytics services, we will ensure they handle data according to standard privacy practices. Typically, we aim to use minimal cookies or trackers, and wherever possible, we lean on the inherent transparency of the blockchain for analytics (for instance, we can count how many entries were sold by checking on-chain, without needing Google Analytics to tell us). However, basic web server logs capturing IP addresses and requests might be kept for security monitoring and debugging.
14.4 Cookie Notice:
If our website uses cookies or similar technologies, it would primarily be for things like remembering your preferences (e.g., dark mode or language selection) or maintaining a session if we have a login (the current version of the Game might not require a login beyond your wallet). We do not use cookies to track you across the web or for invasive advertising. A banner or notice will inform you if cookies are being used when you first visit our site, as required by law in some jurisdictions.
14.5 Data Sharing and Disclosure:
We do not sell your personal information to third parties. We may share data with the following parties in limited circumstances:
Service Providers: We might use reputable third-party providers for services such as email management (for handling support tickets or free entry submissions), cloud hosting, or smart contract auditing. These providers will only have access to data as necessary to perform their functions for us and are typically bound by confidentiality or data processing agreements. For example, if you email us, your email goes through our email service provider, which necessarily processes that content.
Legal Compliance: If we are required by law, subpoena, or court order to disclose certain data, we will comply to the extent the law compels us. For instance, if a regulatory body is investigating a contest, we might have to provide winner information or entry records. We will do our best to limit the scope and to inform users when permissible.
Business Transfers: If the Company or the Game is involved in a merger, acquisition, financing due diligence, or sale of assets, user data (including email lists or blockchain records) could be transferred to a successor or affiliate as part of that deal. If that happens, the same commitments on data use would ideally continue to apply, or we would notify users of any changes.
14.6 Web3 Specific Disclaimers:
Using a Web3 application means some typical privacy expectations differ:
Transparency: As noted, your interactions are public. Even if you don’t directly tell us who you are, your actions can potentially be correlated. There are blockchain analytics firms that might analyze Game data, outside of our control, to glean insights (like who major players are, etc.). By playing a public blockchain game, you’re effectively playing in public.
Pseudonymity: Unless you link your wallet to personal info (like via free entry or by publicly declaring it), we generally only see a wallet address. We treat all addresses the same. However, if unlawful behavior is observed from a particular address, we might have to try to identify the person behind it, which could involve analyzing on-chain clues or other info sources.
Smart Contract Data: The Game’s smart contracts might store certain data on-chain (for example, a mapping of addresses to number of entries, or a flag that an address claimed a free entry this cycle). This data is usually public on the blockchain. By design, we minimize personal data on-chain (we wouldn’t put something like your email or name on-chain; it’s mostly game stats).
No Data Deletion on Blockchain: Blockchain data is immutable. While we can delete or anonymize data on our own servers (like if you asked us to delete your email from our records after a contest, we can do that), we cannot alter what’s recorded on Solana. If you participated, that fact is recorded permanently. Even if you delete the game app or disconnect your wallet, the record of past transactions remains.
14.7 Consent and Privacy Policy:
By agreeing to these Terms, you also consent to the collection and use of information as outlined in this section. If we maintain a separate detailed Privacy Policy, that document is hereby incorporated by reference. In any case where these Terms and the Privacy Policy might conflict (though they shouldn’t meaningfully), the specific terms of the Privacy Policy would govern personal data matters. We will notify users of any significant changes to how we handle personal data, and if required, we will seek updated consent.
14.8 Data Security:
We employ standard security practices to protect any personal data we store. This includes encryption for data in transit (our website should be HTTPS), restricted access to databases, and regular security audits of our platform. However, no system is perfectly secure. By using the Game, you understand that any information you provide to us (or that is collected by us) may be at risk in the event of a breach. We will notify affected users and authorities as required by law if a data breach occurs.
14.9 Activity Logs:
We may keep logs of certain activities for a limited time (e.g., server logs, which might include IP addresses that connect to our web service, primarily for security monitoring and to debug issues). These logs are usually rotated and not kept longer than necessary. We do not build personal profiles of users from this data; it’s mainly for ensuring the service runs smoothly and safely.
In summary, we aim to be transparent and respectful with any data we handle. The core of the Game runs on transparent blockchain rails, which means privacy works a bit differently (more open) than traditional games. We encourage you to use a fresh dedicated wallet for the Game if you want to maximize pseudonymity, and to not share personal info unless needed. If you have any questions or concerns about how we handle data, please contact us (see Section 17).
These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the United States of America and, more specifically, the laws of the State of Nevada, without regard to its conflict of law principles.
We explicitly choose Nevada law due to the Game’s digital and sweepstakes nature, and we intend to operate in compliance with Nevada’s regulations for promotional games and any applicable U.S. federal laws. Note that Nevada does not have special additional sweepstakes requirements beyond general U.S. law, which we endeavor to follow, but we still designate its law for consistency and possibly because our operations or servers are based there.
Jurisdiction and Venue: You agree that any legal action or proceeding arising under or relating to these Terms or the Diamond Hands Game shall be brought exclusively in the courts of competent jurisdiction located in the State of Nevada. This means that if you wish to file a lawsuit against the Company, or vice versa, it will be litigated in either a Nevada state court or (if federal jurisdiction exists) the United States District Court in Nevada. You hereby consent to the personal jurisdiction of these courts and waive any objections (such as claims of inconvenient forum) to litigating in Nevada.
Exception – Injunctive Relief: Notwithstanding the above, the Company retains the right to seek injunctive or equitable relief in any jurisdiction to prevent misuse of our services, intellectual property infringement, or any other immediate harm. But for typical disputes (like a contract dispute or claim of unfairness), Nevada is the agreed forum.
Applicable Law: Using Nevada law means, for example, that any interpretation of these Terms will be according to Nevada’s contract laws. However, note that sweepstakes and gambling-related matters might also invoke federal law (like the FTC rules, etc.), which we have taken into account by including the free entry method. We consider these Terms to comply with U.S. federal sweepstakes law and Nevada state law as applicable. If you are a non-U.S. user, we cannot make any warranty that our approach fully complies with your local laws (hence our advice to check local regulations in Section 2 and 3).
Limitation on Claims: You agree that any claim or cause of action you might have arising out of or relating to the Game or these Terms must be filed within one (1) year after such claim or cause of action arose. If you fail to file within that period, then such claim or cause is permanently barred (this does not apply where prohibited by law, but many jurisdictions allow parties to agree to a shorter limitation period than the default).
Waiver of Jury Trial: To the extent permitted by law, both you and the Company waive any rights to a trial by jury in any litigation arising out of or related to these Terms or the Game. Any disputes would thus be resolved by a judge in a court trial, not a jury. (This is common in contracts to reduce litigation unpredictability, but note this waiver might not be enforceable everywhere.)
No Class Actions: You agree that you will resolve any disputes with us on an individual basis, and not as a plaintiff or class member in any purported class or representative proceeding. This means you cannot bring a claim under these Terms as part of a class action, collective action, or any other type of representative action. A court may opt out of this if it finds it unconscionable, but our intention is to require individual arbitration/litigation only.
Territorial Application: While the Game is globally accessible, the choice of Nevada law and venue means that we are treating the Terms as if they were a contract made and performed in Nevada. If any particular provision is illegal under mandatory consumer protection laws in your country, those laws might override that specific piece, but the rest of the Terms remain enforceable. We do not submit to the law of any other country through these Terms except as required by a court of competent authority.
In summary, Nevada law governs these Terms, and Nevada courts are the agreed venue for any disputes. We hope to never have a dispute serious enough to go to court, but if it happens, this is the framework we’ll operate under.
The Company reserves the right to update, revise, or change these Terms and Conditions at any time. Because the Game may evolve (with new features, changing regulations, etc.), we may need to modify the rules or terms under which it operates. By continuing to participate in the Game after any changes to the Terms, you agree to be bound by the revised Terms.
16.1 Notification of Changes:
When we make material changes to these Terms, we will provide appropriate notice to users. This may include:
Posting the updated Terms on our official website or application interface, with a new “Last Updated” date (as reflected at the top of this document).
Where feasible, a brief summary of major changes (either in a changelog section, a blog post, or an announcement on our community channels such as our Twitter/X or Discord if one exists).
In some cases, direct notification via email or via a notice in the app (especially if you have an account or if the changes are significant and could affect your rights or obligations).
For minor or clarifying changes that do not materially affect user rights (for example, fixing typos, improving wording, or updating contact information), we may not provide advance notice, but the updated Terms will still be posted.
16.2 Acceptance of Changes:
After updates are made, the next time you participate in the Game (for example, by purchasing an entry or claiming a prize) or access our website, you may be prompted to review the new Terms. If you do not agree to the revised Terms, you must stop using the Game and its related services. Continuing to use the Game following the effective date of updated Terms constitutes your acceptance of those changes. It’s your responsibility to review the Terms periodically for any updates, especially if you see announcements of changes.
16.3 Material Changes During a Cycle:
If we happen to update the Terms in the middle of an active game cycle (which we generally try to avoid to prevent confusion), and if those changes materially affect that cycle’s rules or your participation, we will ensure that the changes do not unfairly prejudice players who have already entered. For instance, if a rule change could affect how a winner is chosen or an entry’s validity, we might apply it starting the next cycle rather than mid-cycle, or provide a remedy if needed. Our aim is not to change the “deal” on you after you’ve paid for entries in a given cycle.
16.4 Emergency Changes:
On rare occasions, we may have to make immediate changes without prior notice if required for legal compliance or to protect the integrity of the Game. For example, if a new law takes effect at once, or if a severe exploit is discovered, we might modify or suspend aspects of the Terms (and game rules) immediately. We will still post the changes and notify users as soon as practicable in such cases.
16.5 Archival and Versioning:
For transparency, we may keep an archive of previous versions of the Terms accessible (e.g., on our website). This allows anyone to see how the Terms have evolved. In any dispute, the version of the Terms in effect at the time of the specific incident in question will be used to resolve the issue. We will date each version clearly (as at the top of this document).
16.6 No Oral Modifications:
Any representation or statement by any Company employee or agent (for example, in support chats or on social media) cannot override or change these written Terms. Official changes to Terms must be made in writing (via the processes above). If you’re ever told something by support that seems to conflict with the Terms, the written Terms prevail unless we’ve officially updated them.
By keeping the Terms up to date, we aim to ensure clarity and compliance. We appreciate our community’s understanding that such changes are sometimes necessary and we encourage you to read notices about updates. Your continued support and participation in the Game under the evolving Terms is appreciated.
If you have any questions, concerns, or feedback about these Terms or the Diamond Hands Game in general, please feel free to reach out to us. We are committed to addressing user inquiries and improving the user experience.
Contact Methods:
Email: The primary way to contact us is via email at info@valmeme.com. This is our official support and inquiries email. We endeavor to respond to emails within 1-3 business days, although response times may vary based on the volume of inquiries. When emailing, please include a clear subject line (e.g., “Diamond Hands Game Inquiry” or “Issue with Prize Claim”) and provide as much detail as possible about your question or issue, including your wallet address if relevant to the inquiry.
Official Website Contact Form: (If available) We may have a contact or support form on our official website valmeme.com or the Diamond Hands Game portal. Submissions through that form will be directed to our support team as well. Again, be detailed in your message.
Social Media: You can reach out via direct message or mentions to our official social media profiles (for example, our Twitter/X account @storeofval). We might not address complex account-specific issues in public channels for privacy reasons, but we will try to respond or direct you to the right support route. Please do not share sensitive information (like seed phrases or personal data) over social media. We may ask you to move the conversation to email if needed.
Community Channels: If a community chat (such as Discord or Telegram) exists for the Game, you might find community moderators or other users willing to help with general questions. However, official support is via the channels above. Be cautious of unsolicited help from strangers in community chats – always verify you are talking to an official representative for sensitive matters.
Support Hours: Our support team is generally active during standard business hours (for example, 9 AM – 5 PM, Monday through Friday, Pacific Time) excluding holidays. We will make efforts to monitor urgent issues outside these hours (especially during critical game events or cycle endings), but response may be slower. Critical outages or problems with the Game will be addressed as soon as possible, potentially with announcements on our website or social media if a widespread issue occurs.
Language: All official support is provided in English. We will do our best with inquiries in other languages (we might use translation tools) but we cannot guarantee accurate support in languages other than English at this time.
Reporting Issues: If you believe you have discovered a bug, security vulnerability, or error in the Game, please report it immediately through our contact channels (preferably by email with subject “Bug Report” or “Security Issue”). We appreciate the community’s help in finding issues and will address them promptly. Serious security reports might be eligible for a bounty or reward at our discretion, as a token of thanks for helping us keep the platform safe (if we have a formal bug bounty program, we would publish those terms separately).
Dispute Resolution Contact: Before initiating any formal dispute (like a lawsuit or public allegation), we strongly encourage you to contact us to resolve the matter informally. Many problems can be solved through communication. We are open to discussing your concerns and finding a resolution amicably.
Additional Resources: Frequently asked questions (FAQs), game guides, and rule clarifications may be available on our official site or community forums. Please check those resources if you have general questions, as you may find instant answers there.
Lastly, thank you for being part of the Diamond Hands Game community. We welcome your input and are here to help ensure your experience is smooth, fun, and fair. By working together and communicating openly, we can maintain an enjoyable game for everyone.
